1. Introduction

Welcome to Profit Guard System (“we,” “us,” or “our”).
By accessing or using our website, tools, software, or related services (collectively, the “Services”), you agree to be bound by these Terms and Conditions (“Terms”) and our Privacy Policy and Full Disclosure.
If you do not agree, you must not use the Services.

Profit Guard System provides technical indicators, panels, and analytical tools designed for educational and informational use in platforms such as TradingView® and MetaTrader 5®.
We do not provide investment advice or execute trades on behalf of users.

2. Eligibility

You must be at least 18 years old (or the legal age of majority in your jurisdiction) to use our Services.
By using the Services, you represent that you have the legal capacity to enter into a binding agreement.

3. Educational Purpose Only

All content, tools, and materials provided by Profit Guard System are for educational and informational purposes only.
We are not registered investment advisers or broker/dealers with the U.S. Securities and Exchange Commission or any state authority.
Nothing on our site or within our tools should be construed as financial or investment advice.
You are solely responsible for your trading and investment decisions.

4. Account Registration

Some features may require you to create an account.
You agree to provide accurate and complete information and to maintain the confidentiality of your login credentials.
You are responsible for all activity that occurs under your account.

We reserve the right to suspend or terminate accounts that violate these Terms, misuse the Services, or engage in fraudulent activity.

5. Intellectual Property Rights

All content, software, graphics, and other materials available through the Services are the intellectual property of Profit Guard System, protected by U.S. and international copyright, trademark, and intellectual-property laws.

You may not copy, distribute, resell, modify, reverse-engineer, or create derivative works of any of our materials or software without our express written consent.
The name “Profit Guard System”, our logos, and all associated designs are trademarks of Profit Guard System and may not be used without authorization.

6. License and Usage

When you purchase or access our tools, you are granted a limited, non-exclusive, non-transferable, revocable license to use them for personal, educational trading analysis only.

You may not:

  • Share, sell, or transfer your license to another person;

  • Upload, publish, or distribute our code or visuals publicly;

  • Attempt to modify, decompile, or extract source code;

  • Use our products to offer paid or free signals or copy services;

  • Use the Services for unlawful or unauthorized purposes.

Violation of these restrictions will result in immediate license termination and may lead to legal action.

7. Payments and Subscriptions

All prices are listed in U.S. Dollars unless stated otherwise.
Payments for licenses or subscriptions are processed securely through third-party payment providers.

By completing a purchase, you agree that:

  • All sales are final, except as required by law;

  • Refunds are only issued in accordance with our stated refund policy;

  • You are responsible for maintaining valid payment information for recurring subscriptions.

Profit Guard System reserves the right to change pricing or subscription terms at any time, with notice provided on our website.

8. No Guarantees or Warranties

Profit Guard System provides its tools and Services on an “as-is” and “as-available” basis.
We make no warranties or guarantees, express or implied, regarding:

  • The accuracy or reliability of our indicators, signals, or analytical results;

  • The availability or performance of third-party platforms such as MetaTrader 5® or TradingView®;

  • The achievement of any specific financial or trading outcome.

You understand that trading and investing involve risk, and you may lose part or all of your capital.
Past performance does not guarantee future results.

9. Third-Party Platforms and Data

Our Services may integrate with or display data from TradingView®, MetaTrader®, CBOE, CME Group, CoinAPI, BarChart, or other providers.
All such third-party trademarks are property of their respective owners and are not affiliated with Profit Guard System.

Market data is provided “as is”, may include delays, and should be independently verified.
Profit Guard System assumes no liability for errors, omissions, or delays in third-party data feeds.

10. Limitation of Liability

To the fullest extent permitted by law, Profit Guard System and its representatives shall not be liable for any direct, indirect, incidental, consequential, or special damages arising from the use or inability to use our Services, even if advised of the possibility of such damages.

Your sole remedy for dissatisfaction with the Services is to stop using them.

11. Indemnification

You agree to indemnify and hold harmless Profit Guard System, its owners, affiliates, and representatives from any claims, losses, damages, liabilities, and expenses (including attorney’s fees) arising out of your use or misuse of the Services or your violation of these Terms.

12. Termination

We reserve the right to suspend or terminate your access to the Services at any time, without notice, if you breach these Terms or misuse our tools.
Sections 5–11 of these Terms will survive termination.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Florida, USA, without regard to conflict-of-law principles.
You agree that any dispute shall be resolved exclusively in the courts of Broward County, Florida.

14. Changes to These Terms

Profit Guard System may update or revise these Terms at any time.
Updates will be posted on this page with a revised “Last Updated” date.
Your continued use of the Services after such changes constitutes acceptance of the updated Terms.
